Engaging in one or more of these activities may result in termination of this Agreement.
The CRCable.Net Internet Services may be used only for lawful purposes. You agree that you will not:
- post, upload, reproduce, distribute or otherwise transmit unauthorized or unsolicited commercial e-mail, junk or bulk e-mail, chain letters or other "spam";
- You shall not post or transmit through CRCable.Net any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, pornographic, unlawfully promote hatred or post or otherwise transmit objectionable information, which encourages conduct that would constitute a criminal offence, gives rise to civil liability or otherwise violates any law, or which, without CRCable.Net's express prior approval, contains advertising or any solicitation with respect to products or services. Without limiting the generality of the foregoing, you shall not post or transmit on or through CRCable.Net any data or software which contains a virus, worm or other harmful component;
- engage in threats, harassment, intimidation, stalking or abuse of others;
- scan or probe another computer system;
- obstruct or bypass computer identification procedures;
- engage in unauthorized computer or network trespass;
- export equipment, software or data outside of Canada or the United States in contravention of applicable export control legislation;
- post, upload, reproduce, distribute or otherwise transmit information or materials where such activity gives rise to civil liability, or otherwise violate the rights or assist others to violate the rights of CRCable.Net or any third party; such violations include but are not limited to engaging in copyright infringement, trademark infringement and defamation;
- post, upload, reproduce, distribute or otherwise transmit information or materials where such activity constitutes a criminal offence, or otherwise engage in or assist others to engage in any criminal offence; such offences include, but are not limited to, communicating hatred, pyramid selling, unauthorized use of a computer, mischief in relation to data, fraud, obscenity and child pornography;
- engage in or assist others to engage in any activity that otherwise violates established or accepted network etiquette, violates applicable charters, FAQS, policies, rules or guidelines of CRCable.Net Internet Services or other parties, disrupts or threatens the integrity, operation or security of the CRCable.Net Internet Services or any computer or Internet system, elicits complaints from other Internet users, is contrary to any law or regulation or, in the sole judgement of CRCable.Net Internet Services, is otherwise objectionable;
- otherwise violate CRCable.Net's Acceptable Use Policy at http://www.crcable.net/aup.php, as it may be updated from time to time;
- use or register CRCable.Net's trade-marks, trade names or logos, including without limitation any such trade-marks, logos or service marks displayed on any web site(s) operated by CRCable.Net, without CRCable.Net's express prior written permission;
- share, resell, reproduce, copy, distribute, redistribute, or exploit for any commercial purposes, any portion of, use of or access to, the CRCable.Net Internet Services, except where expressly authorized by CRCable.Net;
- or allow any other person or entity to engage in any of the foregoing activities while using your CRCable.Net Internet Services account.
- The residential service price is based on one machine using the network. Operating any type of server, other than a gaming server, will result in the de-activation of your modem, and may ultimately result in permanent disconnection of your service. Allowances will be made for those client applications that require quasi-server behaviour but do not distribute data.
- The provisions of this Section 6 are for the benefit of CRCable.Net, its affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly on its own behalf.
If at any time you become aware of any violation, by any person or entity, of the acceptable use rules set out in Acceptable Use terms above, which involves your account, you agree to immediately notify CRCable.Net and provide CRCable.Net with assistance, as requested, to stop and/or remedy such violation.
Without limiting any of CRCable.Net's rights to suspend, restrict or terminate your CRCable.Net Internet Services account as described elsewhere in this Agreement, CRCable.Net may suspend, restrict or terminate your CRCable.Net Internet Services account without notice if, in CRCable.Net's sole and absolute discretion, you have violated any of the acceptable use rules set out in the Acceptable Use terms above. You acknowledge and agree that CRCable.Net shall not be responsible or liable to you or any third party for any suspension, restriction or termination of your account.
The following information is in regards to CRTV's policies and is provided for reference only. Information should be verified with CRTV and is subject to change.
Account Information
You agree to provide true, current, accurate and complete customer information as prompted by CRTV's registration process or as otherwise requested by CRTV or its agents and you agree to promptly notify CRTV of any changes to this information as required to keep it current, complete and accurate You agree to provide CRTV with prior written notice of any changes of your billing information, including but not limited to changes in address and contact information..
High Speed Service Installation
Extra charges shall apply to all services not included in CRTV's standard installation options.
The Customer agrees to provide representatives of CRTV access at reasonable times to the Customer's premises and the Customer's computer equipment to install, inspect and maintain all CRTV-owned equipment, and upon termination of any or all of CRTV's services to permit access by CRTV for removal of the CRTV-owned equipment, from the premises, provided however that failure of CRTV to remove its property shall not be deemed abandonment thereof. Access to your premises will be at a time that is mutually convenient for you and CRTV.
CRTV Equipment
Should you have a High Speed modem and associated components provided for your use as part of the CRCable.Net Internet Services High Speed service then these are at all times owned by CRTV. You hereby agree not to sell, transfer, lease, assign any interest in, or encumber all or any part of the CRTV-owned High Speed equipment.
You agree that you will not open, tamper with, service or make any alterations to any CRTV-owned equipment. You shall not allow any person, other than yourself or authorized CRTV personnel, to remove any CRTV-owned equipment, from the premises designated herein and its point of initial installation, nor shall you allow or encourage others in any way to service or deal with any portion of CRTV's equipment or materials.
Limited Warranty
CRTV warrants that the Cable Modem is free from defects in material and workmanship and agrees to repair or replace the Cable Modem if found to be defective.
Payment
You shall pay all monthly fees charged by CRTV for use of CRCable.Net and all applicable taxes as per the billing policies of CRTV.
Rights of Termination
Upon termination of the Agreement, any balance owing for installation shall become due at once. Upon return of the Cable Modem and any other supplied equipment, CRTV shall rebate any part of the service charge paid in advance for service following the first day of the month after the date of disconnection, provided there are no other charges outstanding on your service account. to remove its material and equipment, including without limitation the Cable Modem.
The Customer shall pay reasonable collection fees and/or pick-up charges to CRTV in the event that Company shall find it necessary to enforce collection and or preserve and protect its rights under this Agreement.
